1. Contract

Welcome to kitchen-fittings.co.uk. Kitchen- fittings.co.uk is an online trading shop for Keal & Co of Timothys Bridge Road, Stratford Enterprise Park, Stratford-Upon-Avon, Warks CV37 9NQ. Keal & Co have been trading for 30 years. Keal & Co also operates the web site kealco.co.uk. These terms and conditions relate to the supply of goods sold through kitchen-fittings.co.uk.

We reserve the right to make changes to the website and the terms and conditions at any time without notification.

All orders placed are subject to acceptance by us. A confirmation e-mail will be sent on receipt of order, containing the details of the order. The order represents your offer to us to purchase a product. Acceptance is made when we confirm by email dispatch of the goods to you, which constitutes a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order. Any product on the same order which has not been confirmed in a confirmation e-mail of dispatch does not form part of the contract.

For contractual purposes you agree that communication by email satisfies any legal requirements with regard to written confirmations.

2. Pricing and Availability

We endeavour to offer consistently low prices across our range of products. All prices are listed in Pounds Sterling and are inclusive of UK VAT at the appropriate rate.

Some discounts are time and / or availability limited offers. Placing an item in the shopping cart does not reserve the right to receive the goods at the price shown, where the goods are unavailable we will contact you for further instruction. Due to the nature of offers, prices will be subject to change. We reserve the right to change prices without notification.

Mis-pricing

Occasionally, with the thousands of products on offer an error is made in the price shown on the website. If a product's correct price is higher than our stated price, we will either notify you of cancellation of order or process the transaction at no additional cost to you, at our discretion. In the event of the correct price being lower we will charge you the lower price.

3. Delivery

Please allow up to 5 days for delivery. In the event that a delivery date cannot be met, we cannot
be responsible for any loss suffered by the Buyer owing to our inability to meet such dates. Delivery can only be made to the United Kingdom.

4. Returns and Refunds

If you are not satisfied with any of the products purchased online, you may cancel your order within seven days of delivery. All returns must be accompanied by a returns form .Goods must be returned to us in their original packaging and in a re-saleable condition. Cost of returning goods can only be reimbursed where the goods are faulty. We will reimburse any reasonable costs incurred in returning faulty goods to us. This does not affect your statutory rights.

Please ensure goods are returned in their original condition with all packaging and labels intact to receive a refund. If you wish to exchange items for an alternative item, costs apply as if processing through the normal shopping cart. Any damage or loss in transit to goods returned must be taken up with the mail service or courier company used as we do not accept liability until goods have been received by us. Unwanted items must be returned at your own cost. We may provide a substitute product where the product ordered is unavailable; if this product is unacceptable as a replacement the item may be returned within 14 days for a full refund, subject to us having the option to nominate the carrier.

Certain goods that fail before the manufacturers warranty date will need to be returned to the manufacturer for inspection before any credit can be given. See the manufacturers information for guarantees.

Payment by Cheque
Where you chose to make payment for goods by cheque, please allow for 7 days after receipt of this cheque before your order will be processed. This is to ensure sufficient time for funds to be cleared.

6. Customer Account

You must ensure your account and password details are kept confidential to prevent unauthorized access to your account. You must let us know if you believe your details have become known to anyone else or if you believe anyone has accessed your account. Please ensure your account details are kept updated.

We reserve the right to close an account, cancel any order and remove or edit content at our discretion.

7. Site Access and Usage

Although we will try to ensure the site is available 24-7, it may be necessary to temporarily take the site offline. We shall not be liable for any losses that may occur as a result of the site being down.
You may download and print extracts from this website for your personal, non-commercial use. Any use of extracts of this website for any other purpose is prohibited.

8. Force Majeure

We will not be liable for failure to deliver, delay in delivery or for damage to any goods supplied that is caused by anything beyond our reasonable control.

9. General

Due to the differences in output from display screens. We cannot guarantee that the appearance of colours of products shown on this site exactly match the physical products. Natural products may show some colour variations. All sizes quoted are approximate.
If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
